Craft Board at http://perlygates.net End User License Agreement This software comes with no implied warranties. It comes as is and is constantly being updated. Your feedback is appreciated in reporting any errors by emailing team@perlygates.net. This is free software which is used as an interface for browsing, uploading, and downloading data and graphics from Perlygates.net data servers. There is no trial period. It is a FREE tool to install or use on the web. There are parts of this software are not free and those functions prompt for a user subscription. Administration for perlygates.net may change the pricing for these features at any time. Users will be notified posting notices on our website of upcoming changes. Definitions: These abbreviations define who or what is being referred to in the agreement. Craft Board: which includes all files and folders within the installation directory CBSF: Craft Board setup file which may be appended with a version # CBF: Any file extracted by the setup file ( CBSF ) within the installation directory or downloaded by the Craft Board. End User: Anyone who uses this software. Web User: User uses the web version of this software. Public: Any person. Template: Any or all parts of a design, including files and images, and text data. Associates: Any person who purchase access through subscriptions. Requirements for Selling Goods: All sellers must have have a PayPal business account. A seller can get their type of account upgraded if necessary by following the easy steps listed at paypal.com. The Craft Board uses paypals security system to ensure the buyers are dealing with reputable sellers. Purchase Panel Access Requirements: The only requirement for to purchase access to add your own items is the ability to pay the monthly subscription fee. We use paypals service for subscriptions. If you cannot use this payment method please email team@perlygates.net to find how to prepay for 6 months. If you're not selling items you do not need a paypal account. Software Usage: You may use this software to purchase items, design various crafts, or share designs and images you have added. You may not use or alter images added from another user without their express permission. If a user shares a file using the shared files panel that is considered express permission to alter the file. However these alterations are never shared publicly unless the new altered file is again submitted for sharing. Users may send each other files privately for their own personal reasons. Content Restrictions: Perlygates.net editors have the right to restrict any file from being posted publicly on the Craft Board due incompatability with the software purpose or inappropriate content for the majority of users. No nudity, violent, or controlled substances images will be approved. Because the word offensive is different for all users the determining factor for not publishing is decided by the ediitor who will give the end user an explanation for disqualifying a submission by email. Content must adhere to paypals posted policy to add public content. Our percentage of consignment fees is based on item placement on the internet or within the Craft Board. There is no human intervention for charging fee's or changing rates for each item. The only refund issued is when a seller was double charged for a sale of the same item. This is highly unlikely due to paypals procedures which prevents most double charges. And also because fee's are automatically deducted for each item time at the point of sale. Subscription Refunds There are no refunds for subscriptions for panel access. Any over payments are applied to the following time periods. For refunds of hosting prepayments and other monthly payments please refer to the agreement given for that particular service. Refunds on Goods Sold The Craft Board provides no physical goods shipped. The Craft Board is a service to allow contacting between the interested parties and provides a seller with an area to post their own store refund policy. The administrators, associates, and proprietor of the Craft Board are not responsible for transfer of goods requested from any seller to a buyer. To get a refund for purchased items you must contact the seller directly. You may bring any seller to our attention for poor customer service. We reserve the right exclude sellers from posting items for sale due to customer complaints of any reasonable nature. Selling and Posting Rates If you post in more viewed areas there is a higher percentage rate on the sale of that item. The rate is figured when they put the item in the request list. These rates may vary between 3% to 20%. So if a seller removes an item from the higher percentage area but the buyer still has the item in their request list at the higher rate, it is up to the seller to disallow the item for purchase to keep from being charged the higher rate. There is no human intervention for charging fee's or changing rates for each item. However the buyer and seller can negotiate different prices which can indirectly change the rate. You may have one item in an order with a %7 consignment fee because it was placed in a banner when the user put it in the request list. And another item may have a %3 rate because it was found within a less viewed public directory. We do not collect any fees if an item does not sell. There are no monthly fee's for posting items for sale. Monthly Fee's We charge subscription fee's through paypal's subscription service. These rates vary for the type of access given the subscriber. We also charge monthly fees for placing banners or providing a web service such as website hosting. These are initiated only buy the purchaser. You will never receive a monthly bill because they are all prepaid. If an items prepayment time has expired we will discontinue the service without being obligated to give notice. We assume if you want the service provided you will contact us for it's continuance. Distribution of the Software The CBSF setup file is freely distributable. You many not alter or change it's content in any manner. You may not accept compensation in any form for its use. Distribution of Content Created If the End User shares a design using the Craft Board the design becomes viewable and downloadable by the public for reuse and modification. Any other public user anywhere may use the design as a template or share a modification of the design. Warranty There are no implied warranties that the Craft Board Software is usable without error or failure. For any issues contact team@perlygates.net so the problem may be resolved. The CBSF files may not be de compiled, reverse engineered, or have their source code viewed by any person without express written permission from the current proprietor of the CBSF. Perlygates.net and it's associates disclaims all warranties, expressed or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement as to the information, materials, content, services and products on perlygates.net and it's affiliated sites. Perlygates.net does not represent or warrant that materials in any affiliated sites are accurate, complete, reliable, current, error-free, or subject to correction. Perlygates.net and it's associates are not responsible for typographical errors or omissions relating to pricing, text, or photography. While Perlygates.net attempts to ensure your access and use of the sites is safe, it cannot and does not represent or warrant that it's site and affiliated sites will be error free, uninterrupted, free from unauthorized access. You expressly agree that use of this software including all content, data, or software distributed by, downloaded or accessed from or through Perlygates.net and it's affiliated sites is at your sole risk and responsibility.
